          of participants of the National Training of Trainers on Women's Rights

“Women's Leadership in the Face of New Risks, Disasters, Crises and Military Conflicts to Promote Gender Equality, Human Rights and Sustainable Development in the KR”.

Bishkek, Kyrgyzstan. 28-30 April, 2022

 

We, participants of the National Training of Trainers on Women's Rights "Women's Leadership in the Face of New Risks, Disasters, Crises and Military Conflicts to Promote Gender Equality, Human Rights and Sustainable Development in the KR", representing deputies of local keneshes, activists, representatives of CSOs from all regions of Kyrgyzstan, living in risk areas exploring causes of disasters and conflicts;

taking into account the new risks and disasters associated with the strengthening of radical fundamentalism in the Central Asian region, including the situation in Afghanistan, border conflicts in the Batken oblast, the war in Ukraine,

taking into consideration the lessons of the pandemic, which showed the weakness and corruption of the authorities at all levels, which negatively affected the human rights situation in Kyrgyzstan,

 declare the need to develop partnership on a parity basis to promote the universality of human rights and freedoms, gender equality, creative economy for sustainable development and prevention of new risks, disasters and military conflicts from the level of communities to the global level. The importance of localizing national plans at local levels, increasing awareness and ensuring equal access of citizens to information and equal participation in the decision-making process at all levels of government.

 

We draw the attention of key decision-makers to the following problems faced by women, leaders and residents of communities that negatively affect the observance of human rights in the regions:

  • Widening gap between the rural areas and their communities and the urban areas in the absence of equal participation in the decision-making process at all levels of government;
  • Weak role and participation of local authorities in prevention of risks and disasters;
  • Unavailability of National Action Plans: UN Security Council Resolution 1325, Sendai Framework for Disaster Risk Reduction;
  • Lack of an inclusive strategy of communication with the mass media and security during risks and their prevention;
  • Strengthening spread and influence of religious fundamentalism, its negative impact on the situation with respect for the rights of women, children and youth.

To ensure the observance of women's rights and promotion of women leaders from the local to global level, it is necessary for the following institutions to take the following actions:

 

JOGORKU KENESH OF THE KYRGYZ REPUBLIC

  • Improve the parliamentary control of the Jogorku Kenesh of the KR via the Ombudsman Institution of the KR with the inclusion of equal participation of women community leaders;
  • Introduce the principle of assessing the impact of adopted laws and state programs on equality, with the participation of all groups of society in Kyrgyzstan;
  • Promote the creation of civic Transparency Committees in communities from the national to global level;
  • Promote equal access to justice and fight impunity;
  • Develop the creative economy from the level of communities to global with equal participation of women and youth, in accordance with the Decree of the President of the KR on supporting the creative economy.

 

STATE BODIES, LSG, CSOs:

Women's rights, peace and security:

  • Comply with the international legal norms on the protection of women and girls ratified by the KR;
  • Ensure the protection of women and girls from multiple discrimination;
  • Take special measures to protect women and girls from all other forms of violence during disasters, crises and military conflicts;
  • Take into account the special needs of women and girls during post–conflict reconstruction, take all necessary efforts to restore peaceful life;
  • Support peace initiatives of women in local communities;
  • Implement the Action Plan on UN Security Council Resolution 1325, adopted on 29 April, 2022 from the level of communities to the global level, strengthening civil monitoring and participation.

 

Women's rights, risks and disasters:

  • The Secretariat of the National Platform for Disaster Risk Reduction under the Ministry of Emergency Situations of the KR, together with the National Advisory Committee should expand the participation of women leaders of local communities in the development of National Action Plans for the prevention of disaster risks and threats,
  • Deputies of the Jogorku Kenesh of the KR should give priority attention to the problems and recommendations coming from women deputies at the local level in promoting communities from local to global,
  • International financial institutions and donor organizations should increase the amount of grant allocation and increase transparency in providing information on projects to reduce gaps between communities,
  • The Cabinet of Ministers of the KR should strengthen coordination and coherence of the activities of government departments for the sustainable development, taking into account new risks and disasters, and recognize that gender inequality is a significant risk factor for the society.      

 

Freedom of expression, communication and security

  • It is necessary to restore the right of citizens to freedom of association, freedom of speech and freedom of expression in the KR, promote gender equality and support women's initiatives for positive change;
  • Encourage freedom of expression, strategic and peacemaking communication skills among women leaders to strengthen their interaction with communities, partners and decision makers, especially in times of crisis.
  • It is important to develop the skills of women leaders and activists in the field of speech and information security, media literacy, combating hate speech and bullying, ensuring their stability in the public sphere.
  • To ensure crisis communications in disaster and conflict zones, a training program should be launched for women leaders, representatives of local authorities and the media to create a close partnership during crises, conflicts as well as in peacetime.

 

Women's rights, justice and equality:

  • Ensure equal access of women in rural areas to economic and information resources, taking into account the specifics of each region of the country and taking into consideration the risks associated with climate change;
  • At the level of the LSG, it is necessary to strengthen control over the implementation of the Law on Protection from Family Violence in the KR through strengthening coordination by the structural units of the Ministry of Labour, Social Security and Migration (MLSSM) and the Domestic Violence Prevention Committee (DVPC), ensuring budgeting and accountability of funding provided from the local budget to implement plans to counteract family violence;
  • Support women's economic initiatives in the regions, particularly through the inclusion of 30% quotas for women's business within the framework of the state concessional lending to rural businesses in 2022;
  • Ensure the availability of psychological and social support for women who have experienced various types of violence, as well as women who have experienced crises, at the level of district social protection services, including via training of crisis consultants from among women leaders in communities.

 

INTERNATIONAL AND DONOR ORGANIZATIONS

  • When providing assistance, international and donor organizations should localize aid centers with the distribution and equal participation of community leaders in available languages, ensuring civil monitoring and evaluation of development projects.

The national training of trainers Change Can't Wait was initiated by the Human Rights Movement "Bir Duino-Kyrgyzstan" in partnership with the Ombudsman Institution of the KR within the framework of the WLP (Women's Learning Partnership) program: "Women's Leadership in the Face of New Risks, Disasters, Crises and Military Conflicts to Promote Gender Equality, Human Rights and Sustainable Development in the KR" and within the framework of the project "Protection of the Political Environment of NGOs Through Involvement of Public Leaders from the Local to the Global Level", and was conducted using the WLP manual Beyond Equality for human rights defenders.

Experience should be attached to a law degree

Shakhboz Latipov, 24 y.o., young lawyer: “When I came to BDK for an internship, I had no experience in legal and human rights activities. Together with experienced senior colleagues, I began to attend trials, studied documents. Gradually my supervisor Khusanbai Saliev began to trust me the preparation of documents, carefully checked them and gave practical advice. Experience comes with time and cases you work on. Every day dozens of people who need help come to us, many of them are from socially vulnerable groups: the poor, large families, elderly citizens. A lawyer in a human rights organization sometimes acts as a psychologist, it is important for him to be able to maintain professionalism and show empathy. At the end of 2019, I successfully passed the exam to get the right to start working as attorney and now I work on cases as an attorney. I turn to my colleagues for help on complex issues, they always give me their advice. This is one of the strengths of the organization: there is support and understanding here.”

Organization unites regions

Feruza Amadalieva, social worker, leader, teacher: “TOT from BDK is a great opportunity to get acquainted with participants from different regions, we continue to communicate on social media and when we meet at events, as close friends, we have such warm relations! At the events, I improved my knowledge, systematized it, clarified how to apply it in practice. I really like the training modules and the way the system of training and practice is built: role-playing games, theory, discussions. Each person expresses himself/herself. I have become a leader for other vulnerable women, I try to help them and engage them in such events.” Feruza Amadalieva is a regular participant of many BDK events, she invites the BDK lawyers to provide legal advice to vulnerable women.

I became confident

In summer of 2019, Nuriza Talantbek kyzy took an active part in conducting regional screenings of documentaries, helped with organizational issues during the campaign dedicated to the International Day in Support of Victims of Torture, participated in trips, and did the TOT on women's leadership. She used to be a migrant, worked for an NGO in Osh, and now works in Bishkek in the service industry. She calls her participation in the TOT “an invaluable experience”: “I first attended such an event, and received exactly the information that I needed, for which I am sincerely grateful to the facilitators. I experienced very difficult issues in my life, and thanks to that knowledge, I was able to overcome them, I persevered! After the TOT, I became more confident, began to better understand the essence of human rights, and learned to defend my interests.”

SHUKURULLO KOCHKAROV

SHUKURULLO KOCHKAROV

The defendant has passed away. The work on his rehabilitation continues.

The case of Shukurullo Kochkarov shows that work on complex cases continues for many years. After the torture he was subjected to in 2010, he became disabled. We managed to get acquittal on one of the charges; the work is ongoing on achieving his rehabilitation and recognition as a victim of torture in order for compensation to be paid. Trials continue without Shukurullo Kochkarov - he died on 2 August 2019. His interests are represented by his father, Saidaziz Kochkarov, who also has a visual disability. “For many years, we have been supported by the employees of BDK, they have been handling the case of my son, they brought him to court because he couldn’t walk on his own, they constantly help our family: my wife and I underwent rehabilitation, they have helped my son by providing him with medicines, they provide all kinds of help”.

DILYOR JUMABAEV

Comprehensive support for victims of torture

Resident of the Kara-Suu district, Dilyor Jumabaev, has extensive experience in dealing with law enforcement agencies. In 2010, he was accused of possessing firearms, and thanks to the work of lawyers, he was acquitted. Two years later, his house was first searched in order to find materials of an extremist nature, but nothing was found. In 2014, he was accused of possessing extremist materials. In court, the prosecutor requested 15 years in prison; the court sentenced him to 6 years. A few years later he was released on parole. “I am grateful to the lawyers of BDK for their expert legal assistance. I participated in a rehabilitation program for victims of torture. When I encounter violations, I recommend contacting this organization.”
